End User License Agreement (EULA)

This End User License Agreement (EULA) is a legally binding document between you (Authorised User) and Wound Logic, and Wound Sandwich (ABN [23 682 729 979] (Wound Sandwich, we, our, or us) regarding your use of our website (Platform) and the resources located on the Platform (Resources) providing guidance on the treatment of wounds.
By accessing or using the Platform and the Resources, you agree to be bound by this EULA. If you do not agree, you must immediately cease using the Platform and the Resources.
Acceptance of Terms
By accessing or using the Platform, you confirm that you:
- are at least 18 years old or have the legal capacity to enter into this Agreement;
- are a medical professional and are capable of exercising your own skill and judgment in determining how best to treat a particular wound or symptom.
Purpose of the Platform
The Platform provides access to Resources giving general medical recommendations and information. However, the information provided via the Platform and through the Resources is for informational purposes only and does not constitute medical advice, diagnosis, or treatment. You are required to rely on your own skill and judgement as a medical professional before applying any of the information or recommendations provided in the Resources.
User Account and Security
To access certain features of the Platform, you may be required to create an account. You are responsible for maintaining the confidentiality of your login credentials, including your username and password.
You agree not to share your login credentials with anyone and to notify us immediately of any unauthorized access or use of your account. The Company is not liable for any loss or damage arising from your failure to keep your login credentials confidential.
License Grant
Wound Logic and Wound Sandwich grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform and the Resources for personal, non-commercial purposes in accordance with this Agreement.
Prohibited Conduct
We use Cookies and similar tracking technologies to track the activity on Our Service and store certain information. Tracking technologies used are beacons, tags, and scripts to collect and track information and to improve and analyze Our Service. The technologies We use may include:
Prohibited Conduct
You agree not to:
- create derivative works based on the Platform or the Resources;
- print any part of the Platform or the Resources except:
- those portions identified by us as print friendly; and
- extracts of documents forming part of the Resources which does not constitute a reproduction of a substantial part of that document for the purposes of applicable copyright law,
and provided that any printed portion or extract is only printed for the your personal use;
- use the Platform or the Resources to create any product with the same or similar primary function.
- merge any part of the Platform or the Resources with any other database;
- attempt to modify, adapt, translate, reverse engineer or otherwise interfere with or derive source code from the Platform or the Resources ;
- access any part of the Platform or the Resources mechanical, programmatic, robotic, scripted or other automated services; or
- obscure or remove any trademark, brand name or copyright notice or other symbol of ownership from any part of the Platform or the Resources.

All recommendations and information provided on the Platform are:
- Based on general knowledge and public resources.
- Not tailored to individual medical conditions.
The Company is not liable for any actions taken based on the information provided.
Platform Availability
While we strive to keep the Platform continuously available and operational, we cannot guarantee uninterrupted access or availability. The Platform may experience downtime due to maintenance, technical issues, or other unforeseen circumstances. We are not liable for any disruptions or unavailability of the Platform.
Australian Consumer Law
This Agreement is governed by the laws of Australia, including the Australian Consumer Law (ACL).
Nothing in this Agreement excludes or limits your rights under the ACL, including guarantees of acceptable quality and fitness for purpose. If you believe our services fail to meet these guarantees, please contact us.
Limitation of Liability
To the maximum extent permitted by law, the Company is not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Platform. This includes, but is not limited to, loss of data, health complications, or financial losses.
If liability cannot be excluded under applicable laws, the Company’s total liability is limited to the resupply of services or the cost of resupply, at our discretion.
Privacy
Your use of the Platform is subject to our Privacy Policy, which explains how we collect, use, and store your personal data.
Termination
We may terminate or suspend your access to the Platform at any time, without prior notice, for any breach of this Agreement or applicable laws. Your access to the Platform and the Resources may also be subject to an agreement with your employer entity that has engaged you as a health professional.
Governing Law
This Agreement is governed by and construed in accordance with the laws of Australia. Any disputes arising from this Agreement will be subject to the exclusive jurisdiction of the courts of New South Wales.
Amendments
We reserve the right to modify this Agreement at any time. Any changes will be effective immediately upon posting on the Platform. Your continued use of the Platform constitutes acceptance of the amended terms.
